By joining Joister as a customer, you agree to follow these terms and conditions during the whole time that you have a service with us – and beyond.
The user retains his/her ownership to the information uploaded by the user by accessing the Joister website and its services, except those rights which are needed to keep the services of Joister active and/or for hosting user files, sharing of information, technical administration, backup of data etc. The user by accepting the terms and conditions gives permission to use such limited rights with regard to trusted third party websites with whom Joister works to provide its services.
Joister does not monitor the contents including files, folders, photos, audios, videos, shared by the user on the Joister website for their accuracy, legal compliances etc. and the users must themselves ensure that they comply with the accuracy and other legal requirements. Joister reserves the right to monitor any information and to remove any obscene, pornographic or objectionable content of whatsoever nature at any time without any prior notice to the user. Joister takes no responsibility for any activity of the user as to their files, folders and other information.
Due to the nature of the Service technology, Joister Infoserve reserves the right to deem the service unavailable to you up to, including, and after the installation. Joister Infoserve assumes no liability whatsoever for any claims, damages, losses or expenses arising out of or otherwise relating to the unavailability of the Service in your geographical area, for any reason, even where such unavailability occurs after installation of the service.
Joister services are available on a user account which is protected by the user's password. Joister accepts no responsibility for the dilution or violation of the user account due to the disclosure of the password to any third party by the user. Joister will however take notice of unauthorized use of the user account immediately on the user notifying Joister of such unauthorized use. In order to protect data during transmission, the user must use an encrypted connection. Joister shall not be responsible for loss of data during transmission.
The customer acknowledges that spamming of emails is prohibited. Spamming is the transmission of any form of mail that can be interpreted as junk mail or mail generated via a distribution list, which the recipient has not specifically requested. Joister Infoserve Pvt. Ltd. reserves the right to terminate the services if this is violated by any user.
The customer shall take full and sole responsibility for preserving the secrecy of the password. The Service Provider shall not be responsible for any wrongful or unauthorized use, under any circumstances.
Currently all IP provided by Joister Infoserve. are Dynamic and may change with every login. however customer can avail static ip by showing the justification and paying associated charges for it.
For enhanced security, User ID, Password and MAC address (unique for each CPE) will be tied to each other. This means that a User ID can be used only from that users PC and IP address allocated to the user. However, it is possible for the user to have multiple plans under one user id.
The customer hereby undertakes to indemnify and hold harmless The Service Provider against liability, which may effect Joister Infoserve for any and all, acts on the part of the Customer in availing the service.
The Service to be provided shall be exclusively to the Customer. The customer shall not transfer, reassign, sell, and/or share the services with others including the affiliates of the Customer.
Customer account will be suspended if complain regarding torrent / illegal downloads are received and will be reactivated only after receiving the signed copy of "Content removal declaration form".
The customer is liable to pay for optical devices or cable post 6 months of their comprehensive warranty. All other spares are chargeable.
The customer understands and is responsible to take outmost care of CPE devices and wires in his premises, where damages due to lightning, earthquake, rain and theft may be out of Joister Infoserve's control.
Joister reserves all rights which are hereby not expressly granted to the user. The user acknowledges that all the software's, copyrighted material, brand names, logos, trademarks and service marks of Joister are the intellectual property of Joister Infomedia Pvt. Ltd and the use of Joister services does not grant the user any right, title or interest in such property. The breach of such intellectual property rights of Joister by user shall be deemed to be material breach and the user will be liable to pay damages in the Court of Law.
Joister respects the intellectual property rights of others. The user must ensure that all the files, data or information, which the user may be sharing, copying, uploading and downloading does not infringe the rights of others. Joister shall immediately delete or erase any such information on receiving any notice of infringement from any third party or from the law enforcement authorities, without any prior notice or intimation to the user. Joister accepts no responsibility or liability for any copyright or trademark or patent infringement or violation of any such other rights due to sharing, copying, uploading and downloading of infringing files, folders or other infringing material. Any complaint regarding such infringement may be sent to email@example.com.
Joister may use third party services, softwares, applications to provide its services more effectively and make them user friendly, however, Joister does not guarantee the authenticity, accuracy and availability of such third party services and applications. The user shall be using such third party services at the his/her discretion and risk and if Joister uses any open source softwares, provisions of such open source softwares will be applicable.
All sales of Recharge are final and there will be no refund or exchange permitted. Please be advised that You are responsible for the account number you purchase Recharge for and all charges that result from those purchases. Company is not responsible for any purchase of Recharge for an incorrect account number.
However, in a case where a transaction has been completed by you on the Site, and money has been charged to your card or bank account but a Recharge has not delivered within 24 hours of your completion of the transaction then you may inform us by sending us an email on firstname.lastname@example.org or posting us a message on the Contact US page. In such a scenario you will be entitled to a full refund. We request you to include in the email the following details - Recharge value, Transaction date and Order Number joister shall investigate the incident and if it is found that money was indeed charged to your card or bank account without delivery of the Recharge then you will be refunded the money within 7 working days from the date of the receipt of your email.
After termination of services, Joister has every right to repossess router or any other hardware installed at the place where the link is commissioned.
Although Joister strives to provide the best of its services, its services are available on "AS-IS" basis. Joister does not undertake any warranty or guarantee in respect of its services. Joister will not be responsible for any injury to the user and user's devices or the loss of the user's data for the use of Joister Services.
These terms supersede any former terms and conditions of the use of Joister services and do not create any third party beneficiary rights. The rights of the user in respect of the use of Joister services are non-transferable and not assignable, however Joister reserves the right to assign or transfer its rights to its lawful assignee or affiliates or successors. If any of the provisions of these terms and conditions is not enforceable, then such part of the terms and conditions which are enforceable shall remain in full force and effect, however, Joister shall not be considered to have waived up any rights not expressly mentioned in these terms.
